Railway Group D Court Case Order 2025 Out

O R D E R
18.09.2025

1. This hearing has been done through hybrid mode.
2. The present petition under Section 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India seeks the following prayers-
   • Initiate contempt proceedings against the Respondents for wilful disobedience of the order dated 28.07.2025 read with interim order dated 06.03.2025 passed by this Hon’ble Court in WP. (C) No. 2771 /2025;
   • Stay the operation of the impugned circular dated 08.09.2025 (Annexure P-3); whereby the Respondents have released examination dates in violation of this Hon’ble Court’s order.
   • Pass such other and further orders as may be deemed fit and proper in the facts and circumstances of the present case.
3. Learned counsel appearing on behalf of the petitioner draws attention of this Court to interim order in W.P.(C) 2771/2025 dated 06.03.2025, which reads as under: –
   • The question arises as to whether, as the advertisement was issued on 28 December 2024, it was permissible for the respondent, thereafter, to, by the notification under challenge before the Tribunal, allow applicants who did not have the ITI/NAC qualifications and were merely 10th pass to apply in response to the advertisement.
4. On that issue, Mr. Sinha, learned Counsel for the respondents, would also have to address on the applicability of the recent decision of the Constitution Bench of Supreme Court in Tej Prakash Pathak v Rajasthan High Court1.
5. Mr. Sinha, learned Counsel for the respondents, submits that, given the seriousness of the matter, time may be given to file a reply.
6. Issue notice to show cause as to why rule nisi be not issued.
7. Notice is accepted on behalf of respondent by Mr. R. V. Sinha.
8. Counter affidavit, if any, positively be filed on or before 22 March 2025 with advance copy to learned Counsel for the petitioners, who may file rejoinder thereto, if any, on or before 28 March 2025.
9. Mr. Sinha, learned Counsel for the respondents, submits that no recruitment would take place till the next date of hearing.”
10. Subsequently, vide order dated 28.07.2025, the aforesaid writ petition was disposed of by learned Division Bench in the following terms: -.
    • “1. This petition has been filed by the petitioners, challenging the Order dated 14.02.2025 passed by the learned Central Administrative Tribunal, Principal Bench, New Delhi (hereinafter referred to as ‘Tribunal’) in O.A. No.296/2025, titled Niranjan Kumar v. M/O Railways, whereby the application for interim relief filed by the petitioners in the said O.A. was dismissed.
    • This Court, by its Interim Order dated 06.03.2025, had recorded the statement of the learned counsel for the respondents that no recruitment would be made till the next date of hearing. The said interim order has continued.
    • In the meantime, we are informed that the learned Tribunal is not proceeding with the adjudication of the O.A. due to the pendency of the present writ petition, and has adjourned the same sine die. The Order dated 02.05.2025 passed by the learned Tribunal has been placed on record in this regard.
    • In view of the above, we dispose of this writ petition by directing that the statement made by the learned counsel for the respondents shall continue to operate during the pendency of the O.A. before the learned Tribunal.
    • We direct that the O.A. be listed before the learned Tribunal on 18th August, 2025. The parties shall appear before the learned Tribunal on the said date.”
    • Learned counsel appearing on behalf of the respondent, on advance notice, submits that the circular dated 08.09.2025 pertains to the exam schedule, which is tentative. For the sake of completeness, a copy of the circular dated 08.09.2025 is reproduced hereinbelow: –
11. Perusal of the aforesaid circular reflects that, although it is stated to be tentative, but it has been issued for the purpose of recruitment, regarding
12. which a statement has already been made on behalf of the respondent which is continuing till date.
13. Issue notice.
14. Learned counsel appearing on behalf of the respondent accepts notice and seeks time to file a response/status report. Let the same be done before the next date of hearing.
15. In the meantime, the aforesaid circular shall remain stayed till the next date of hearing.
16. List on 08.10.2025.
17. The aforesaid date has been given at request of the learned counsel for the respondent.
18. Order be uploaded on the website of this Court forthwith.
